As students return to Korea from studying in the United States, many will need to apply for new visas.  This summer student season is a very busy time at the US Embassy in Seoul and around the world, so we thought a few tips would help ensure everyone has as smooth an interview as possible.

미국에서 학업을 하다 한국에 일시 귀국한 학생이 다시 미국에 갈때  새로운 비자가 필요할 때가 많습니다.  여름 성수기에는 서울을 포함 전세계 미국 대사관 업무가 많아집니다.  이러한 성수기에  원할한 인터뷰를 받기 위해 도움이 될수 있는 몇가지 정보를 드리고자 합니다.

Question: Do I have to speak English for my interview? What if I need to speak Korean? Q: 인터뷰시 영어를 해야하나요? 한국말로 하면 어떻게 되나요?

Answer: Some visa categories require applicants to speak English; others do not. 

A: 다양한 종류의 비자들 중 일부는 신청자들이 영어를 하도록 요구됩니다; 일부를 제외한 나머지 종류의 비자들은 영어가 요구되지 않습니다. 

IV Question of the Week: Can I travel to the United States while my application for an immigrant or fiancé(e) visa is being processed? 금주의 IV 질문: 이민비자나 약혼자비자가 수속 중인데 미국에 잠깐 다녀올 수 있나요?

Answer: Yes, but be careful.

Should you use a visa broker? 비자 대행 업체를 이용하시겠습니까?

Many Korean travelers choose to submit their visa applications through a visa broker or lawyer.  That is perfectly acceptable; however, before paying for somebody else to prepare your visa application, it’s a good idea to consider what a visa consultant can and cannot do for you.

대부분의 한국인이 비자 신청서를 비자 대행 업체나 변호사를 통해서 접수하고 있습니다.  물론 이러한 방법이 잘못된것은 아닙니다.   그러나 비자 신청 서류 준비를 위한  대행 수수료를 지불하기 전에, 비자 컨설턴트가  실질적으로 어떤 도움을 줄수 있는지를 한번 고려해 보시는게 좋을것 같습니다.

Question of the Week: Can I work on a Student Visa? 금주의 질문: 유학생 비자로 미국에서 일할 수 있나요?

Answer:  It depends.  Your main purpose in going to the United States is to study.  You can’t just go work at the corner market or at a restaurant in your free time.  If you want to work you need to make sure you get the proper authorization and remain in student status. 

답변: 경우에 따라 다릅니다. 귀하가 미국에 가려는 주된 목적이 학업인 경우 귀하가 여가시간이 있다고 근처 가게나 식당에서 일을 할 수 있는 것이 아닙니다. 미국에서 일을 하길 원하는 경우 적절한 허가를 받아야 하며 학생신분도 유지해야 합니다.

My grandchild has a plan to study in Los Angles for one year. I would like to stay in the U.S. for one year to take care of him and travel. Can I apply for a B-2 visa for this purpose? 손자가 Los Angeles 에서 일년간 공부할 예정입니다. 일년간 미국에가서 손자를 돌보고 여행도 하려고 합니다. 이 경우 B-2 를 신청하면 되는지요?

There is no visa specifically to travel as the parent or guardian of a student.  You may apply for a B-visa if your purpose of travel to the U.S. is for a short term visit for business and/or pleasure.  However, we are unable to pre-adjudicate a visa application before an application is received at the time of the scheduled interview.  All visa requirements and application procedures are available on our website, http://www.ustraveldocs.com/kr_kr/index.html.

Department of Homeland Security (DHS) officers determine admission into and length of stay in the U.S. at a port of entry. The maximum period of stay for a B visa is generally six months, but if you want to stay beyond the period of time authorized by the DHS, you must file a request with U.S. Citizenship and Immigration Services (USCIS) before your authorized stay expires.  More information is available at www.uscis.gov.

Why does U.S. compulsory education law pertain to my child visiting or studying in the U.S.? / 왜 미국 의무 교육법이 내 자녀의 미국 방문이나 학업과 관련이 있는 것입니까?

Because even short-term visitors are subject to U.S. laws; whether they are federal, state, or even local.  In the United States, every state has a compulsory education law, which requires that children attend a school appropriate for their age, unless homeschooled by a state-approved program.  The age requirements vary from state to state.  The minimum age ranges from 5 to 8 and the maximum age ranges from 16 to 18.

아무리 짧은 기간의 방문자라도 미국에 있을때는 연방법, 주법, 지역법등 미국 법의 적용을 받게 되기 때문입니다.   미국에서는 각 주에 의무교육법이 있어 주에서 인가한 프로그램에 의한 홈 스쿨링이 아닌 이상 일정 나이가 되면 학교에 다녀야 합니다.   나이 제한은 주에 따라  다르나  최소 5-8세 사이의 나이부터 최장 16-18세 사이의 나이입니다.     

The Consul Asks You: What are you afraid of? 영사가 당신에게 묻습니다 – 무엇이 가장 걱정되세요?

The consular officers at the U.S. Embassy in Korea want you to have a pleasant experience when you come for a visa interview.  The consular officers here are all nice people, they have interesting hobbies, nice families, good stories, they all speak at least some Korean and love living in Seoul.  Under any other circumstances, you would probably really enjoy chatting with them.  But, when it comes to the visa interview, many of our applicants get so nervous that they can barely speak to the officer, and that usually results in a less-than-ideal interaction.

Good news for travelers to the United States 미국여행에 관한 희소식

Good news for travelers to the United States:  Beginning March 9th, 2012, applying for a U.S. visa will become easier and less expensive.  With only one payment (the current application fee based on the visa classification), all visa processing services will be provided to all applicants under the Global Support Strategy (GSS) by the U.S. Embassy’s authorized partner, CGI Stanley.

The GSS portal will be your resource for managing the U.S. visa application process from start to finish, including:

• Visa application fee collection, either over the counter at any Citibank, or online via Electronic Funds Transfer (EFT) through your own bank, where available
• Visa interview appointment scheduling
• Answers to general visa questions
• Delivery of passports for approved visa applications

Visa applicants currently pay additional fees for some of these services.  Beginning March 9, 2012, these additional costs will be eliminated and the single fee paid at the beginning of the application process will cover all required services. 

The U.S. Embassy encourages all visa applicants to visit our website (seoul.usembassy.gov) for more details on these important changes. 

미국여행에 관한 희소식:  2012년 3월 9일자로 미국비자 신청절차가 간소화되고 비용은 저렴해집니다.  Global Support Strategy (GSS) 정책에 의해 미국대사관의 협력업체인 CGI Stanley는  한번의 비자신청수수료 (수수료는 현재와 마찬가지로 비자종류별로 차등적용됨) 납부로  비자신청시 아래의 서비스를  제공받을 수 있도록 할 것입니다.

New Visa Application Process Unraveled! 새로운 비자 신청 절차!

The Global Support Strategy (GSS) is now fully operational in Seoul.  Visa applicants can now apply for and pay for visa services online.  The good news is that applicants no longer have to pay for additional services associated with receiving a visa.  Everything is included in the original fee payment; from scheduling an appointment to receiving your passport.  There’s even a call center and email address that applicants can use for additional information.  Though we here at the Embassy are excited about the service upgrades for our visa applications, we understand that change requires a period of adaptation as people become familiar with new systems.  This week, we would like to review the visa application steps with you to help make the transition to the new services smoother.  Below, we have highlighted the new steps to apply for a visa appointment.

GSS 시스템에 의한 새로운 미국비자 신청절차가 한국에서 시행이되었습니다.

Attention to Detail: Many travel agents and visa brokers offer to facilitate your travel to the United States for a fee by arranging internships, work, travel, study, and cultural exchange programs.  These third-party businesses do NOT operate on behalf of the U.S. government.  All U.S. government web sites can be identified by the domain name .gov (e.g., http://seoul.usembassy.gov).

Question of the week:  It’s my first time applying for a student visa and I want to enter the U.S. early enough to have sufficient time to get prepared before my school starts.  Can I apply for my student visa as soon as I get my I-20 from the school?

Legal Troubles and the DS-160 법률적인 문제와 비자 신청서(DS-160)

In the course of filling out the DS-160, applicants are asked:

Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty, or other similar action?

On occasion, applicants make mistakes in response to this question.  Let us look at three cases and see how each of these applicants should answer the question above.

When do I need a new student visa? 언제 새로운 학생비자가 필요합니까?

Nearly all students planning to study in the United States will need to apply for a student visa at the U.S. embassy before leaving Korea.  However, the rules about when continuing students need to renew their visas are a little more complicated.  When you transfer schools or take a break from your studies, you may (or may not) need to get a new visa.

미국에서 공부할 계획이 있는 거의 대부분의 학생들은 출국하기 전에 미국 대사관에서 학생비자를 신청하셔야 합니다.  그러나, 미국에서 학업을 계속 하려고 하는 학생들의  경우 학생비자 재발급의 필요 여부는 조금 복잡합니다.  학교를 편입하거나 혹은 잠시 휴학중인 경우 비자를 다시 받아야 하는 경우도 있고 다시 받을 필요가 없는 경우도  있습니다 .
